Prepaid

1. This contract is entered between Fast Telecommunication Company W.L.L (First Party) and the subscriber (Second Party) for the contract period as commencing in date of providing the second party with the service. Whereas the First Party is entitled to terminate the contract in case the Second Party violates any of the terms and conditions of the contract under the rules and regulations of the law; and/or in the event whereby instructed by authorities in the Ministry of Communication and/or any related body in the State of Kuwait; without any financial compensation or retrieval of the financial remainder of this contract.

2. The second party undertakes to acknowledge all the conditions and applicable laws in the State of Kuwait as issued by the competent authorities; subsequently in the event of breach of the terms and conditions of this contract, the second party shall bear all responsibilities incurred.

3. First party reserves the right to add or change or amend any of the provisions herein, if necessary, without need for notifying the subscriber. The Arabic version of this agreement will prevail if any inconsistencies or differences between the Arabic and English text arise.

4. The second party undertakes to agree to advanced payments to the first party, in accordance with the prices set forth by the first party, in exchange for the provision of the internet service.

5. Second Party commits, agrees and understand that his/her subscription is for in-house use purposes only. Therefore, the Second Party agrees not to connect, waive, commercially use, resell for any third party, Sublease, connect to the local or international networks or distribute the service to any housing or accommodation whatever or commercial or non-commercial offices, residential compounds, multiple flats or houses.

6. The second party undertakes not to use the VOIP service; being commercial or non-commercial; in the operation of online phone service.

7. Second Party undertakes to preserve the rights of intellectual property, copyright and trademark under the laws of the State of Kuwait. The second party also undertakes not to use the first party’s equipment or network in any way, shape or form contrary to the laws and regulations of the State of Kuwait; specifically those related to any decisions issued by the Ministry of Communication in Kuwait and any laws issued concerning the organization of Internet service in Kuwait, this includes actions such as hacking, online browsing, online transactions and so forth which may result in loss of any kind. The first party will not be held accountable for such violations, loss and compensation.

8. The first party is under no obligation to bear the responsibility, and/or compensate the second party for delay caused by any technical errors, including online gaming performance, defects, official authorities’; and/or any other external factors that may affect the quality of service performance

9. The first party will not be held accountable to compensate the second party for any defect and/or error at the disposal of the second party, caused by the official authorities and/or any reasons beyond the reasonable control of the party first.

10. Due to the inefficiency of the line; in the event where the line capacity cannot carry or handle the requested speed, a reduction in speed will apply and credit compensated on user account duration.

11. Subscription fees for new accounts KD 5, Collection fee KD1; Change service fees KD10 and FAST Fix service fees KD 10 are non-refundable; if the subscriber requires a site installation fee KD 10 and site visit fee KD 20 are non-refundable.

12. All purchased devices and/or gifts are non-refundable, not subject to exchange and Hardware only assumes 3 months manufacturer’s warranty from the date of purchase; the latter does not cover accessories.

13. If cancellation takes place before the contract expiration date; the second party is obliged to pay 25% of the total amount of the agreement. In addition to the above, if FAST GO service is included to the package, 80 KD shall be deducted from the total amount of the agreement.

14. After the expiration of service duration, the first party is entitled to remove all necessary service connections in the Ministry of Communication if exceeding two months from the expiration date.

15. After the expiration of the contract; In case of cancellation 60 days before the Closing Date, in addition to the Ministry of Communications’ removal of connections; the second party shall pay a fee of 10 KD. Note that connections will be removed within 10 working days from the date of cancellation.
